2. Description of LumaPush
LumaPush provides web push notification infrastructure, subscriber management tools, automated campaigns (AutoMagic RSS/Drip sequences), segment creation, and analytics for website owners ("Publishers").
3. Eligibility
You must be at least 18 years of age or the legal age of majority in your jurisdiction to create a LumaPush account. By using our Services, you represent and warrant that you have full legal capacity to enter into a binding contract.
4. Accounts and Account Security
You are responsible for maintaining the confidentiality of your account credentials (email, password, API keys). You agree to immediately notify LumaPush of any unauthorized use of your account or security breaches.
5. Acceptable Use
Publishers must use LumaPush in compliance with all applicable local, national, and international laws, including privacy and anti-spam regulations.
6. Push Notification Consent Responsibilities
Publishers are strictly required to obtain valid, explicit browser permission from visitors before sending push notifications. Publishers must not trick, mislead, or force visitors into subscribing.
7. Customer Responsibilities
You are solely responsible for the content, media, links, and timing of push notification campaigns dispatched through your account. LumaPush acts as a technology infrastructure provider.
8. Prohibited Activities
You agree NOT to send push notifications that contain:
- Malware, phishing, deceptive software, or fraudulent links.
- Illegal goods, adult content, harassment, hate speech, or defamatory material.
- Unsolicited spam or deceptive clickbait designed to trick users.
Violation of these guidelines will result in immediate suspension or termination of your account without notice.
9. Subscriptions / Payments
LumaPush offers Free and Paid subscription tiers (Pro, Business, Enterprise). Paid plans are billed on a recurring monthly or annual basis depending on your selected billing cycle.
10. Refund Policy

11. Service Availability
We strive to maintain maximum platform uptime and reliability. However, LumaPush does not guarantee uninterrupted or error-free operation of push delivery, as delivery depends partly on browser push services (FCM/Apple APNs).

Our platform may contain links or SDK integrations with third-party websites or services. LumaPush is not responsible for the content or practices of third-party platforms.
13. Intellectual Property
The LumaPush name, logo, dashboard design, codebase, and documentation are the exclusive intellectual property of LumaPush.
14. Customer Data
Publishers retain ownership of their campaign content and subscriber list data. LumaPush is granted a limited license to process data solely to deliver the service.
15. Privacy
Our collection and use of information is governed by our Privacy Policy.
16. Termination
We reserve the right to suspend or terminate access to the platform for accounts that breach these Terms or engage in abusive push practices.
17. Disclaimers & Limitation of Liability
The Services are provided "as is" without warranties of any kind. LumaPush shall not be liable for indirect, incidental, or consequential damages resulting from platform use.
18. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of LumaPush after changes take effect constitutes acceptance of the new Terms.
